Respondent-appellant having applied for permission to proceed as a poor person and for the assignment of counsel on the appeal taken herein from an order of the Family Court, Livingston County, entered in the Office of the Clerk of said Court on May 7, 2008,
Now, upon reading and filing the certification of Mary Kay Yanik, Esq., dated June 2, 2008, and due deliberation having been had thereon,
It is hereby ORDERED that the application is denied with leave to seek poor person relief and the assignment of counsel by motion that includes an affidavit from respondent-appellant indicating his intention to pursue the appeal.
