Appellant having moved for an extension of time to perfect the appeal taken from an order of the Court of Claims entered in the Office of the Clerk of said Court on August 1, 2007, and for other relief,

Now, upon reading and filing the affidavit of Michael A. Davis sworn to June 10, 2008, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be, and the same hereby is, granted to the extent that the ordering paragraph of the order of this Court entered June 2, 2008 is hereby amended by deleting the date June 26, 2008 and inserting in its place the date October 21, 2008, and the motion is otherwise denied.

Memorandum: Pursuant to 22 NYCRR 1000.4 (a) (1) (ii), the contents of the record must be settled by the Court of Claims if the parties cannot stipulate. No further extensions to perfect the appeal will be granted.
