DECISION & ORDER ON MOTION

Motion by Alicia Romano for leave to appeal to this court from an order of the Family Court, Queens County, dated July 1, 2008, and to stay enforcement of so much of the order as permits one overnight visit with the subject child during each visitation weekend.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
