Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Kings County, rendered September 28, 2004, as abandoned.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied with leave to renew if the appellant fails, on or before September 2, 2008, to either move for poor person relief and the assignment of counsel, retain counsel and notify the court that he has done so, or perfect the appeal.
