DECISION & ORDER ON MOTION

Motion by the respondents-appellants for a preference in the calendaring of an appeal from a judgment of the Supreme Court, Queens County, entered March 24, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and the appeal will be calendared expeditiously after all briefs have been filed; and it is further,

ORDERED that the appellants-respondents shall perfect the appeal on or before November 5, 2008, and the joint record or appendix on appeal (see 22 NYCRR 670.8[c][1]) and the appellants-respondents' brief must be served and filed on or before that date; and it is further,

ORDERED that the respondents-appellants shall serve and file their answering brief, including their points of argument on the cross appeal, on or before December 10, 2008 (see 22 NYCRR 670.8[c][3]); and it is further,

ORDERED that the appellants-respondents shall serve and file their reply brief, if any on or before January 14, 2009; and it is further,

ORDERED that the respondents-appellants shall serve and file their reply brief on or before January 29, 2009.
