Appellant having moved to vacate the dismissal of the appeal taken from a judgment of the Oswego County Court entered in the Office of the Clerk of the County of Oswego on September 30, 2004,

Now, upon reading and filing the affidavit of Jorge Denis, sworn to April 30, 2008, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be and the same hereby is granted, on the condition that the appeal is perfected on or before October 22, 2008.
