ORDERED that the order on application of this court dated July 22, 2008, in the above-entitled action is recalled and vacated and the following order on application is substituted therefor:
Application by the respondent Henryk Cioczek pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time of the respondents to serve and file their respective briefs on an appeal from a judgment of the Supreme Court, Kings County, entered October 12, 2007.
ORDERED that the application is granted and the respondents' time to serve and file their respective briefs is enlarged until September 4, 2008, and the respondents' briefs shall be served and filed on or before that date.
