DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of a judgment of the Supreme Court, Nassau County, dated February 5, 2008, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the appellant's notice of appeal from an order of the same court dated February 9, 2007, is deemed to be a notice of appeal from the judgment dated February 5, 2008 (see CPLR 5512); and it is further,

ORDERED that the motion is denied.
