DECISION AND ORDER
ON MOTION


Application by appellant for poor person status and for permission to prosecute this appeal pro se.

Upon the papers filed in support of said application, and no papers having been filed in opposition thereto, it is

ORDERED that the application is granted and the appeal may be perfected in accordance with section 800.14 of Rules of Practice (22 NYCRR 800.14). The County Court Clerk of Sullivan County is directed to furnish to appellant one copy of the transcripts of the stenographic minutes of all proceedings in the matter, except those portions which appellant or the criminal court determines are unnecessary for perfection of the appeal, and to forward the other copy to the Clerk of this Court pursuant to section 800.4(c) of the Rules of Practice. Appellant's time to perfect appeal is extended to 45 days after the minutes are filed in the office of the Sullivan County Court Clerk. In the event the minutes are not filed within 60 days from the date of this decision, within 10 days thereafter, appellant shall move on notice for a further extension of time using the form of affidavit furnished by the court.
