Missouri Assets, LLC (Nick Partners) v White, Alton, et al.
It is Ordered that the motion and cross motion are consolidated for disposition. The execution of the warrant of eviction is stayed through September 10, 2008. This is to afford the appellant a final opportunity to perfect the appeal from the December 27, 2007 order / judgment of the Civil Court. ( see 22 § NYCRR 640.6 ) If, prior to said date, the appeal has been perfected and the appellant is current in the payment of accruing use and occupancy, then the latter may move for a continuation of the stay. Otherwise, the warrant of eviction may be enforced after September 10, 2008.
