ORDER TO SHOW CAUSE

Appeal by Troy Sneed from a judgment of the Supreme Court, Kings County, dated February 16, 2007. By order on application dated June 23, 2008, the appellant's application to enlarge his time to perfect the appeal was granted and the appellant's time to perfect the appeal was enlarged until July 31, 2008. The order on application was mailed to the appellant but was returned by the post office as undeliverable.

Now, on the court's own motion, it is

ORDERED that the parties or their attorneys show cause before this court why an order should or should not be made and entered dismissing this appeal as abandoned by filing an affidavit or affirmation on that issue with the Clerk of this court on or before September 5, 2008; and it is further,

ORDERED that the order on application of this court dated July 25, 2008, in the above-entitled case, is recalled and vacated; and it is further,

ORDERED that the Clerk of this court or his designee is directed to serve a copy of this order to show cause upon the appellant at his last known place of residence or, if he is imprisoned, at the institution in which he is confined by ordinary mail pursuant to CPL 470.60(2), and upon the attorney, if any, who last appeared for him, and upon the District Attorney, by regular mail.
