| DECISION & ORDER ON MOTION |
Appeal, by permission, by the defendants from an order of the Supreme Court, Westchester County, dated September 12, 2007. By decision and order on motion dated October 17, 2007, so much of the order as prohibited Carl Bruce from serving as pastor of the Mount Carmel Baptist Church, Inc., was stayed pending hearing and determination of the appeal or hearing and determination of the petition of the respondents Pamela Thompson, Woella Gulliver, Florina Talbert, Ruth Guthrie, and Sarah Moore by the Supreme Court, Westchester County, whichever occurred first. The appeal has not been perfected.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the stay granted by the decision and order on motion dated October 17, 2007, is vacated forthwith.
