| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from a resentence of the County Court, Suffolk County, imposed April 24, 2005, pursuant to chapter 738 of the Laws of 2004, which was determined by decision and order of this court dated April 15, 2008, in effect, to relieve counsel assigned to prosecute the appeal and to assign him new counsel to make any motions deemed appropriate with respect to the decision and order of this court dated April 15, 2008, including a motion for leave to appeal to the Court of Appeals from the said decision and order of this court. By decision and order on motion dated August 2, 2006, the following named attorney was assigned to prosecute the appeal:

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, Annamatesha Howell, Esq., is relieved from representing the appellant and the following attorney is assigned to represent the appellant to make any motions deemed appropriate with respect to the decision and order of this court dated April 15, 2008, including a motion for leave to appeal to the Court of Appeals from the said decision and order of this court:
