DECISION

Motion by appellant for a stay pending appeal is granted. Appellant shall within 10 days from the date of the order hereon deposit with the court below the amount of $29,119.59 with proof thereof to be filed with this court within one day after such deposit; upon such deposit, the restraining notice is vacated. The appeal shall be perfected by September 5, 2008.

In the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay on 3 days' notice.
