Motion by the petitioner-respondent and the respondent-respondent, inter alia, to dismiss an appeal from an order of the Supreme Court, Suffolk County, dated August 7, 2007, on the ground that it has been rendered academic.
Upon the papers filed in support of the motion and the papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that the movants' time to serve and file their respective briefs is enlarged until September 24, 2008, and the briefs must be served and filed on or before that date.
