Appellant having moved for permission to proceed as a poor person and assignment of counsel on the appeal taken from a judgment of the Monroe County Court entered in the Office of the Clerk of the County of Monroe on May 16, 2008,

Now, upon reading and filing the affidavit of Timothy S. Curran, sworn to June 20, 2008, the notice of motion with proof of due service thereof, and due deliberation having been had thereon,

It is ORDERED that the motion for poor person relief and assignment of counsel be and the same hereby is denied with leave to renew upon submission addressing any dependents living in the household and the value of the assets that the spouse of defendant maintains at Citizen's Bank.
