| DECISION & ORDER ON MOTION |
Motion by the appellant to stay his deposition in the above-entitled action pending hearing and determination of appeals from two orders of the Supreme Court, Richmond County, dated April 27, 2007, and June 15, 2007, respectively. Cross motion by the respondent to dismiss the appeals. Separate motion by the appellant for leave to appeal to this court from the orders if the court determines that leave to appeal is necessary.
Upon the papers filed in support of the motions and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion to stay the appellant's deposition is granted, and the appellant's deposition is stayed pending hearing and determination of the appeals; and it is further,
ORDERED that the motion for leave to appeal to this court is granted; and it is further,
ORDERED that the cross motion is denied.
