| DECISION & ORDER ON MOTION |
Motion by the respondent to strike the appellant's reply brief on an appeal from an order of the Supreme Court, Westchester County, dated November 15, 2007.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the appellant's reply brief is stricken; and it is further,
ORDERED that the appellant may serve and file a replacement reply brief on or before September 15, 2008, if so advised, that includes and refers to only those documents that were before the Supreme Court, Westchester County, in connection with the motion and cross motion that resulted in the order on appeal and does not include or refer to matter dehors the record; and it is further,
ORDERED that no enlargement of time to serve and file the reply brief shall be granted.
