It is Ordered that the motion is granted to the extent of permitting the warrant of eviction to be executed after September 9, 2008. If, by said date, the appeal has been perfected and the September use and occupancy has been tendered, then the appellant may move for a continuation of the stay. Otherwise, the warrant of eviction may be enforced after September 9, 2008.
