DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from a judgment of the Supreme Court, Queens County, rendered April 14, 2004, for leave to reargue that branch of its prior motion which was to unseal the minutes of proceedings which occurred on February 26, 2003, in an action entitled People v Ruiz, pending at that time under Superior Court Information No. 2002QN050945, in Part AP-N, which was determined by decision and order on motion dated April 22, 2008, and to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to reargue is denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted; and it is further,

ORDERED that the respondent's time to serve and file a brief is enlarged until October 8, 2008, and the respondent's brief must be served and filed on or before that date.
