It is Ordered that the motion is granted to the extent of vacating the stay of the execution of the warrant of eviction. The re-renting of the apartment is stayed through October 8, 2008. If, by said date, the appeal has been perfected, then the appellant may move for a continuation of the stay of the re-renting of the apartment. The papers submitted as a cross-motion, not having been timely served, were considered solely in opposition to the motion. ( CPLR § 2215 )
