| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of so much of an order of the Family Court, Suffolk County, dated August 25, 2008, as directed the return of the subject child Sean S. to Allison B. and to continue the status of the subject child Sean S. with his current foster care family, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the motion is granted, and enforcement of so much of the order dated August 25, 2008, as directed the return of the subject child Sean S. to Allison B. is stayed and the status of the subject child Sean S. is continued with his current foster care family pending hearing and determination of the appeal.
