It is Ordered that the motion is granted only to the extent of permitting the appeal to proceed on the original record of the trial court. The motion insofar as it seeks a stay is denied, without prejudice to renew after the deposit of five thousand dollars ( $5,000.oo ) - with the Clerk of the Civil Court. This sum represents less than half of the use and occupancy arrears outstanding.
