DECISION

On the court's own motion, motion by assigned counsel Brendan O'Meara, Esq., returnable July 9, 2008 and cross motion by respondent returnable July 11, 2008 are hereby consolidated for purposes of disposition.

Motion by assigned counsel Brendan O'Meara, Esq., to be relieved of representing appellant on the appeal is granted.

Cross-motion by the People to dismiss the appeal is granted and the appeal is dismissed as abandoned (see People v Cullum, 170 AD2d 524 [1991]; People v Jinks, 140 AD2d 371, 372 [1988]).
