Respondents New York State Office of General Services and New York State Office of Parks, Recreation and Historic Preservation having moved for an extension of time to file and serve briefs on the appeal taken from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on February 25, 2008,

Now, upon reading and filing the affirmation of Kathleen M. Treasure dated August 20, 2008, the notice of motion with proof of service thereof, the affirmation of Richard J. Brickwedde dated August 25, 2008, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be, and the same hereby is, granted on condition that the brief is filed and served on or before September 23, 2008, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that reply briefs, if any, shall be filed and served on or before October 8, 2008, and

It is further ORDERED that the appeal is hereby removed from the October 30, 2008 day calendar of this Court, and added to the calendar for the term of this Court commencing December 1, 2008.
