Now, upon reading and filing the affidavit of Ramadhan Rajab, sworn to July 29, 2008, the notice of motion with proof of service thereof, the letter of John Bradley, dated September 3, 2008, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be and the same hereby is granted, and John Bradley is hereby directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before October 15, 2008.
Memorandum: The submitted 22 NYCRR 1022.11 (a) form does not contain sufficient information to allow this Court to conclude that counsel properly advised defendant of his appellate rights in writing. As a consequence, defendant's motion for an extension of time to file and serve a notice of appeal is granted.
