DECISION & ORDER ON MOTION

Motion by the appellant Vanessa J. on appeals from an order of the Family Court, Queens County, dated November 29, 2007, to strike the briefs of the respondent and the attorney for the child on the ground that they refer to matter dehors the record and to enlarge the time to serve and file a reply brief. Separate motion by the appellant Marvin J. to strike the respondent's brief on the ground that it refers to matter dehors the record and, in effect, to enlarge the time to serve and file a reply brief.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the branches of the motions which are to strike the briefs are held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,

ORDERED that the branches of the motions which are to enlarge the time to serve and file reply briefs are granted, the time to serve and file reply briefs is enlarged until September 29, 2008, and the reply briefs must be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted.
