| DECISION & ORDER ON MOTION |
Motion by Anthony Shallash and Rosemarie Shallash on an appeal and a cross appeal from an order of the Supreme Court, Nassau County, entered May 15, 2008, to direct Anthony Carlisi and his counsel to provide copies of all trial exhibits in their possession and for an award of costs.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to direct Anthony Carlisi and his counsel to provide copies of all trial exhibits in their possession is granted, and on or before October 6, 2008, Anthony Carlisi and his counsel are directed to provide copies of all trial exhibits in their possession to the attorneys for Anthony Shallash and Rosemarie Shallash; and it is further,
ORDERED that the branch of the motion which is for an award of costs is denied.
