Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Queens County, entered May 12, 2008.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal from so much of the order entered May 12, 2008, as denied that branch of the appellant's motion which was for leave to renew is denied; and it is further,
ORDERED that the branch of the motion which is to dismiss the appeal from so much of the order entered May 12, 2008, as denied that branch of the appellant's motion which was for leave to reargue is granted, and that portion of the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies from an order denying reargument.
