| DECISION & ORDER ON MOTION |
Motion by the appellant to stay "the divorce summons and complaint dismissal" in the above-entitled action pending hearing and determination of appeals from two orders of the Supreme Court, Kings County, dated July 18, 2008, and August 25, 2008, respectively, and for leave to prosecute the appeals as a poor person.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the motion is dismissed for failure to properly serve the order to show cause.
