DECISION & ORDER ON MOTION

Motion by the respondent to extend the effective date of his suspension from September 26, 2008, until December 26, 2008. By opinion and order of this Court dated September 2, 2008, the respondent was suspended from the practice of law for a period of three years, commencing September 26, 2008. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on October 21, 1953.

ORDERED that the motion is granted to the extent that the effective date of the respondent's suspension is extended until October 10, 2008; and it is further,

ORDERED that the motion is otherwise denied.
