DECISION & ORDER ON MOTION

Motion by Advocates for Children of New York, Inc., Anti-Defamation League, Canine Companions for Independence, Disability Advocates, Inc., Empire State Pride Agenda, Guide Dog Foundation for Blind, Inc., Guiding Eyes for Blind, Lambda Legal Defense and Education Fund, Inc., NAACP Legal Defense and Educational Fund, Inc., New York Civil Liberties Union, and Parents, Families and Friends of Lesbians and Gays for leave to file an amici curiae brief in a proceeding pursuant to Executive Law § 298 and 297(4), which was trasferred to this court by order of the Supreme Court, Nassau County, dated April 14, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the amici curiae brief must be served on the parties, and nine copies filed in this court on or before October 9, 2008; and it is further,

ORDERED that no oral argument by the amici curiae shall be permitted; and it is further,

ORDERED that the parties, if they be so advised, may file reply briefs to the amici curiae brief within 10 days after service upon them of the amici curiae brief.
