On the court's own motion, it is
ORDERED that its decision and order on motion dated July 2, 2008, in the above-entitled matter, which determined a motion by the petitioner in a proceeding pursuant to CPLR article 78, which was transferred to this court by order of the Supreme Court, Dutchess County, dated September 20, 2007, is amended by deleting from the final decretal paragraph thereof the date "September 2, 2008," and substituting therefor the date "September 23, 2008".
