DECISION & ORDER ON MOTION

Motion by the respondent to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Nassau County, entered July 10, 2007, and to strike the transcript of the oral argument contained in the record on appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until October 30, 2008, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that branch of the motion which is to strike the transcript of the oral argument contained in the record on appeal is granted to the extent that the appellant is directed to settle the transcript of the oral argument and on or before October 30, 2008, serve and file a supplemental record containing an errata sheet, or advise the court that no errata sheet is necessary, and that branch of the motion is otherwise denied.
