DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from an order of the County Court, Dutchess County, dated January 26, 2007, to be provided with a copy of the record and the appellant's brief and to enlarge the time to serve and file a respondent's brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the Clerk of the court shall furnish a copy of the record and the appellant's brief to the respondent; and it is further,

ORDERED that the respondent's time to serve and file a brief is enlarged until October 31, 2008, and the respondent's brief must be served and filed on or before that date.
