It is Ordered that the motion for a reinstatement of the stay is denied. The appellant has failed to comply with numerous orders of this court, dating back to March 8, 2008, requiring the prompt perfection of the appeal. Accordingly, the application for a stay is denied. The cross-motion to dismiss is granted unless the appeal is argued or submitted by the January 2009 term. In the event of appellant's failure to comply with the foregoing condition, the petitioner-landlord may move on five days' notice for an order dismissing the appeal.
