It is Ordered that the motion is granted to the extent of staying the turnover of funds to plaintiff herein pending the determination of the appeal on condition that the records and briefs are served and filed by no later than November 12, 2008, in order to be noticed by the January 2009 term. In the event of appellants' failure to comply with the foregoing condition, the plaintiff may move on five days' notice for an order vacating the stay.
