DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to serve and file an appendix to his supplemental brief on an appeal from a judgment of the Supreme Court, Kings County, rendered April 26, 2006.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branches of the motion which are for leave to serve and file an appendix containing the material annexed to the motion papers as Exhibits 2, 3, and 4, are granted, and on or before November 6, 2008, the appellant shall file nine copies of the supplemental appendix and serve one copy on the District Attorney; and it is further,

ORDERED that the branch of the motion which is for leave to serve and file an appendix containing the material annexed to the motion papers as Exhibit 1 is denied.
