| DECISION & ORDER ON MOTION |
Motion by Mercy First to dismiss an appeal from an order of the Family Court, Kings County, dated January 11, 2008, on the ground that the order is not appealable as of right, or to enlarge the petitioners-respondents' time to serve and file their briefs. Application by the attorney for the children to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the application, and the papers filed in opposition and in relation thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that the branch of the motion which is to enlarge the petitioners-respondents' time to serve and file a brief and the application are granted; and it is further,
ORDERED that the time of petitioners-respondents and the attorney for the children to serve and file their briefs is enlarged until November 7, 2008, and the briefs must be served and filed on or before that date; and it is further,
ORDERED that no further enlargements of time shall be granted.
