DECISION & ORDER ON MOTION

Motion by the petitioner to enlarge the time to perfect a proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Queens County, entered September 4, 2007. Cross motion by the respondent to dismiss the proceeding for failure to timely perfect in accordance with the rules of the court.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, the petitioner's time to perfect the proceeding is enlarged until November 23, 2008, and the petitioner's record or appendix and brief must be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted; and it is further,

ORDERED that the cross motion is denied.
