Application by the appellant, inter alia, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Queens County, entered January 28, 2008, and to enlarge the time for the respondents to serve and file a brief and for the appellant to serve and file a reply brief.
ORDERED that the branch of the application which is to enlarge the time to perfect the appeal is granted and the appellant's time to perfect the appeal is enlarged until December 15, 2008, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date; and it is further,
ORDERED that the application is otherwise denied as premature.
