| DECISION & ORDER ON APPLICATION |
Application by the appellant on an appeal from an order of the Supreme Court, Westchester County, entered May 9, 2008, in effect, to amend a decision an order on motion of this court dated September 9, 2008, as granted a stay of enforcement of the order entered May 9, 2008, on condition that the appeal was perfected by October 9, 2008.
Upon the papers filed in support of the application and no papers having been filed in opposition or relation thereto, it is
ORDERED that the application is granted and the decision and order on motion dated September 9, 2008, is amended by deleting from the decretal paragraphs thereof the date "October 9, 2008," and substituting therefor the date "October 23, 2008".
