DECISION & ORDER ON MOTION

Motion by the respondents Laurence Toole and the Town of Ramapo Democratic Committee for leave to appeal to this court from an order of the Supreme Court, Rockland County, dated September 24, 2008, and to stay enforcement of a temporary restraining order contained in said order which restrained the Town of Ramapo Democratic Committee and the Rockland County Democratic Committee from holding organizational meetings, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and enforcement of the temporary restraining order contained in the order dated September 24, 2008, is stayed pending hearing and determination of the appeal or until determination by the Supreme Court, Rockland County, of the motion in the above-entitled proceeding which is returnable on October 22, 2008, whichever occurs first.
