On the court's own motion, it is
ORDERED that its decision and order on motion dated September 29, 2008, in the above-entitled matter, which denied a motion by the appellant, on an appeal from a judgment of the County Court, Orange County, rendered June 26, 2008, is amended by deleting from the first paragraph the word "Dutchess," and substituting therefor the word "Orange".
