Motion by the nonparty-appellant for leave to prosecute an appeal from a judgment of the Supreme Court, Suffolk County, dated June 4, 2008, on the original record and to deem acceptable for purposes of this appeal, the settlement of the trial transcript made by the respondent-appellant.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the appeal will be heard on the original papers (including the transcript of the proceedings, if any) and on the briefs of the parties, who are directed to file nine copies of their respective briefs and to serve one copy on each other.
