Application by the appellants Roman Catholic Diocese of Brooklyn, Bishop Thomas V. Daily, Monsignor James Spengler, Monsignor Otto Garcia, Anthony Danile and St. Elizabeth's Roman Catholic Church, for leave to withdraw an appeal from an order of the Supreme Court, Queens County, dated May 16, 2008.
Upon the papers filed in support of the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the appeal by the appellants Roman Catholic Diocese of Brooklyn, Bishop Thomas V. Daily, Monsignor James Spengler, Monsignor Otto Garcia, Anthony Danile and St. Elizabeth's Roman Catholic Church, is deemed withdrawn, without costs or disbursements.
