On the court's own motion, it is
ORDERED that its decision and order on motion dated October 1, 2008, in the above-entitled matter, which, inter alia, denied that branch of the petitioner's application which was for a writ of habeas corpus, is amended by deleting from the second paragraph the words "the papers filed in opposition thereto," and substituting therefor the words "no papers having been filed in opposition or in relation thereto".
