It is Ordered that the motion to continue the stay of the re-rent of the subject apartment is granted on condition that the appellant perfects the appeal for the January 2009 term - the filing deadline is November 12, 2008. In the event of appellant's failure to comply with the foregoing condition, or in the event accruing use and occupancy has not been tendered to the petitioner, then the landlord may move on five days' notice for an order vacating the stay.
