It is Ordered that the motion is granted only to the extent of staying the proceeding in the trial court pending the determination of the appeal, provided it is perfected by November 12, 2008, and noticed for the next available term. Otherwise, the motion is denied. The re-letting of the premises is continued, without prejudice to petitioner moving in the trial court to vacate its stay, if so advised.
