Motion by the defendant for leave to appeal to this court from an order of the Appellate Term, Second and Eleventh Judicial Districts, dated May 27, 2008, which affirmed insofar as appealed from an order of the Civil Court of the City of New York, Queens County, entered March 19, 2003, and affirmed an order of the same court entered March 17, 2004.
